Legal authority: Laid down by the Ministry of Local Government and Modernisation on 2 May 2018 pursuant to the Act of 15 June 2001 no. 70 on the determination and change of municipal and county boundaries (the Local Government Boundaries Act) section 17, cf. the delegation decisions of 27 October 2017 no. 1666.

Section 1. The scope of the regulations

The regulations apply to municipal council elections in 2019 in municipal authority areas subject to the boundary changes that take effect on 1 January 2020. The term boundary changes is a generic term for mergers, divisions and boundary adjustments, cf. section 3 of the Local Government Boundaries Act.

Section 2. Purpose

The purpose of the regulations is to facilitate so that the inhabitants of municipal authority areas subject to the boundary changes shall be able to elect their municipal council representatives in their new municipality.

Section 3. The relationship with the Representation of the People Act and the associated regulations When conducting the municipal council elections in municipal authority areas subject to boundary changes, the Representation of the People Act and the associated regulations apply with the exceptions and clarifications that follow from these regulations. The provisions of the Representation of the People Act and the associated regulations relating to list proposals, the right to vote, eligibility, advance voting, voting and the right of appeal apply as if the boundary changes have been implemented.

Section 4. The Electoral Committee in municipal authority areas that shall merge or be divided

The Electoral Committee shall be elected by the Joint Committee established pursuant to section 26 of the Local Government Boundaries Act. The Joint Committee may authorise the Electoral Committee to appoint polling committees. Section 4-1 and section 4-2, second sentence do not apply.

Section 5. Two-day elections in municipal authority areas that shall merge or be divided

The Joint Committee may itself resolve that in one or more places in the municipal authority area polling may also take place on the Sunday before the official Election Day. Section 9-2, second paragraph does not apply.

Section 6. The time and place of polling in municipal authority areas that shall merge or be divided The Joint Committee, or the Electoral Committee after delegation, decide into how many constituencies the municipal authority area shall be divided. The Joint Committee may, with the consent of at least 1/3 of the members, decide to keep the polling stations open longer than the Electoral Committee has agreed. Section 9-3, first paragraph, first sentence and second paragraph, fifth sentence of the Representation of the People Act do not apply.

Section 7. Requirements for the number of signatures on list proposals pursuant to section 6-3, second paragraph, letter b) of the Representation of the People Act

When calculating the requirement for the number of signatures, the number of inhabitants entitled to vote in the merged municipal authority areas at the last municipal council election shall be used as a basis.

Section 8. Entry into force

The regulations take effect immediately and expire on 31 December 2019.
