3.4 Øvrige aktuelle saker i 2013
A questão da aplicabilidade do Direito Internacional Humanitário a forças de paz de organizações internacionais é um assunto que levantou algumas dúvidas. Na medida em que nem a ONU, nem a União Africana, são parte das convenções relativas de DIH, nem estas convenções estão abertas à sua adesão, pelos que os seus preceitos só as podem vincular por via costumeira. Portanto, a grande dúvida era a de saber em que medida é aplicável este ramo do direito internacional.
Só em 1999, com a circular emitida pelo Secretário-Geral da ONU, Kofi Annan, relativa ao Respeito do Direito Internacional Humanitário pelas Forças das Nações Unidas, é que a questão da aplicação do DIH ficou clarificada. Nesta circular, o Secretário-Geral define as normas do DIH aplicáveis às forças em missão de paz da ONU330. Determina a Secção 1, relativa ao âmbito de aplicação, o seguinte:
The fundamental principles and rules of international humanitarian law set out in the present bulletin are applicable to United Nations forces when in situations of armed conflict they are actively engaged therein as combatants, to the extent and for the duration of their engagement. They are accordingly applicable in enforcement actions, or in peacekeeping operations when the use of force is permitted in self-defence.331
No entanto, na secção 2 é afirmado que os princípios e regras de DIH elencados na circular não constituem uma lista exaustiva332. Portanto, como afirma Matija Kovac, “[t]herefore it is

uncontested that peacekeeping forces are subject to IHL if the conditions for its applicability are met”333.
Atualmente parece não haver qualquer dúvida sobre a aplicação do Direito Internacional Humanitário às forças em missões da ONU. E tal pode ser constatado pelo Status of Forces Agreement, comummente designados pela sigla SOFA dessas missões onusianas. O SOFA da Missão das Nações Unidas para o Sudão, UNMIS, define o seguinte:
Without prejudice to the mandate of UNMIS and its international status:
a) The United Nations shall ensure that UNMIS shall conduct its operation in Sudan with full respect for the principles and rules of the international humanitarian law conventions applicable to the conduct of military personnel. These international conventions include the four Geneva Conventions of 12 August 1949 and their Additional Protocols of 8 June 1977 and the UNESCO Convention of 14 May 1954 for the Protection of Cultural Property in the Event of Armed Conflict.334
No caso das Missões Hibridas da União Africana e da ONU, também se encontra no Status of Forces Agreement, a referência à obrigatoriedade de respeitar as convenções de DIH encontra- se no SOFA, redigida de idêntica forma à da UNMIS supramencionada, com a devida alteração:
The African Union and United Nations shall ensure that UNAMID shall conduct its operations in Sudan with full respect for the principles and rules of the international humanitarian law (…)335.
Relativamente às Missões da União Africana, o Status of Mission Agreement (SOMA) da Missão da União Africana para a Somália (AMISOM), assinado a 6 de março de 2007 em Adis Abeba, na Etiópia, define o seguinte:
Without prejudice to the mandate of AMISOM and its international status:
a) The African Union shall ensure that the mission conduct its operation in Somalia with full respect for the principles and rules of the international Conventions applicable to the conduct of military and diplomatic personnel. These international

Conventions include the four Geneva Conventions of 12 August 1949 and their Additional Protocols of 8 June 1977 and the UNESCO Convention of 14 May 1954 on the Protection of Cultural Property in the event of armed conflict and the Vienna Convention on Diplomatic Relations of 18 April 1961.336
Aparentemente, a referência à obrigatoriedade de respeitar o DIH, da forma como se encontra redigida nos respetivos SOFA (SOMA, no caso da AMISOM), é menos propício à dúvida no caso da missão africana, do que nas missões onusiana e híbrida. Isto porque, sendo certo que é apenas uma diferença de redação, o SOMA refere, numa tradução livre, que a União Africana deve garantir que a missão é conduzida com total respeito pelas regras e princípios do DIH, por outro lado o SOFA, das missões onusianas, refere que a ONU deve garantir que a missão deve conduzir a sua operação com total respeito pelas regras e princípios do DIH. Desconhecemos se a diferença de redação foi intencional, no entanto, pela redação dos referidos estatutos, entende- se que a AMISOM está obrigada a respeitar as regras e princípios de DIH337 e a UNMIS, ou a UNAMID, estão obrigadas a respeitar as mesmas regras e princípios sempre que for possível. Seja como for, se dúvidas restassem quanto à aplicabilidade do DIH às missões de paz das organizações internacionais, as três missões que referimos, UNMIS, missão da ONU, da UNAMID, missão híbrida da UA/ONU e da AMISOM, missão da UA, são exemplos da aplicabilidade e da obrigatoriedade de respeitar o DIH por missões de organizações internacionais.
2.2. As Missões da União Africana e a obrigação de proteger a população civil – o
